Experienced New York criminal defense attorney suspended for three years in Maine

A Maine Supreme Court judge rejected the Board of Bar Overseers’ recommendation to suspend an experienced New York criminal defense attorney, arguing that a three-year suspension was justified because he allegedly helped bring charges against one of his clients in addition to himself.

Scott L. Fenstermaker, a Harvard Law School graduate with more than 30 years of experience, expanded his solo practice from New York to Maine—but it was short-lived. After being admitted to the Maine bar in May 2022, months later he was temporarily suspended for a variety of things, including filing frivolous and “standard” motions and briefs in cases where he would have been required as a witness, making reckless statements about other judges, and disparaging other attorneys, to name a few.
