Father gets 20 years in prison for raping his daughter who became pregnant

SEREMBAN: A 44-year-old man was sentenced to 20 years in prison and given five lashings by the Sessions Court here after he pleaded guilty to committing incest with his daughter since she was 12 years old, even to the point of to get her pregnant.

The girl gave birth to her father’s baby in August last year.

“Though you have pleaded guilty, the court must give priority to public interest over personal interest,” Sessions Judge Mohamad Kamil Nizam said while pronouncing the verdict.

“As a father, you should care for your child, but in this case you have betrayed that trust and caused him suffering and trauma.

“The court also notes that Parliament has amended the law to provide for harsher punishments for such crimes,” he added.

The accused was accused of committing the offense at around 6am in November 2022 at a house in Kampung Pachitan in Port Dickson. The girl was 18 years old at the time.

He was charged under Section 376B(1) of the Penal Code, which carries a prison sentence of between 10 and 30 years and flogging upon conviction.

Judge Mohamad Kamil said the court also noted that the victim reported the matter to the police only after the defendant and his wife were jailed for a drug-related offense.

Deputy Public Prosecutor M. Kalaivaanan asked the court to impose punishment as the accused repeatedly raped his daughter until she gave birth to an illegitimate child last August.

The accused, he said, had been raping the girl since she was 12 years old.

“Although the defendant has pleaded guilty, this should not automatically be considered a mitigating factor.

“The court should also take note of the increasing number of incest cases and convey the message to the public that these crimes carry severe penalties,” he said.

Kalaivaanan also told the court that Parliament had amended the law twice to provide stricter punishments for such crimes.

In another court on April 28, both the accused and his 45-year-old wife were charged with possession of Yaba pills weighing 32.8g in the same house.

The man pleaded guilty to the charges while his wife filed for trial.

They were charged under Section 12(2) of the Dangerous Drugs Act, which carries a prison sentence of between five years and life imprisonment and a flogging of at least 10 lashes.

Sessions Judge Meor Sulaiman Ahmad Tarmizi fixed July 4 for mention.
