Relatives of man killed in traffic accident reach agreement in dispute with DoorDash

The two surviving relatives of a man killed in Pico Robertson County after a driver allegedly working for DoorDash struck all three pedestrians have settled their lawsuit against the food delivery service and the man driving the car.

The lawsuit in Los Angeles Superior Court was filed on August 10 of last year on behalf of the wife and son of Bing Wang, a 51-year-old Chinese national who was fatally struck on June 7, 2023, as the family passed a Chase bank at the corner of Pico and La Cienega Boulevard.

The car then drove on and crashed into a bank wall.

On Tuesday, attorneys for the plaintiffs filed court documents with Judge Joseph Lipner informing him of the settlement of the case but providing no details.

The driver, Vladimir Tishchenko, who no longer works for DoorDash, got his license less than a month before the accident, according to court filings from the plaintiffs’ attorneys.

“Simply put, Tishchenko was in a hurry to get to the restaurant to pick up the food,” the plaintiffs’ attorneys explained. “He was distracted by looking at the DoorDash navigation on his phone. He had an incentive to get to the restaurant as quickly as possible so he could take advantage of additional DoorDash delivery options.”

DoorDash had authority over Tishchenko, then 36, when making deliveries and asked him to “drive fast and recklessly,” the plaintiffs’ lawyers said in their court documents.

In addition to Wang’s death, his wife Xiaomei, then 48, suffered serious injuries and had to have her left leg amputated. Their son Wenxuan, then 19, suffered moderate injuries.

In earlier court filings, the family’s lawyers presented excerpts from the testimony of Xu Shi, the Los Angeles Police Department investigating officer. Shi answered affirmatively when asked by plaintiffs’ attorney Robert Glassman whether Tishchenko admitted to talking on the phone and turning left shortly before the crash.

“So he looked at the navigation app on his phone to figure out where he needed to go to get the food he wanted to pick up?” Glassman asked.

“Yes,” Shi replied again, adding that he confirmed Tishchenko was driving for DoorDash at the time by calling the company’s customer service line the next day. Shi said the Chinese restaurant that was Tishchenko’s destination was about two blocks from the accident scene.

Four independent witnesses told Shi that they saw Tishchenko speeding before he lost control and the car skidded. Shi concluded that the driver was solely to blame for making an unsafe left turn and driving too fast.
