Bail set for rape suspect at Rockland motel

BROCKTON – The man accused of raping a 15-year-old girl in a Rockland hotel will likely be released on bail this week.

Cory Alvarez’s bail was set at $500. If bail is posted, he must stay at home with a GPS monitor, his public defender Brian Kelley said after a dangerousness hearing Tuesday in Brockton Superior Court.

Alvarez, 26, has been in jail since his March 13 arrest. He was indicted by a Superior Court grand jury on May 21 and set to stand trial on May 31. He has pleaded not guilty to one count of aggravated rape of a child with an age difference of 10 years and rape of a child with use of force. Authorities say the alleged crimes occurred at a Rockland hotel used as a migrant shelter.

Plymouth County Prosecutor Shanan Buckingham said Alvarez is dangerous and needs to remain in jail. Buckingham suggested bail of $10,000 because the charges are so serious and imposed several conditions, including house arrest and GPS monitoring.

If released, Alvarez would be required to report to a probation officer twice a month. His next court date is scheduled for August 13 at 9:30 a.m. in Brockton Superior Court.

Judge largely agrees with the arguments of Alvarez’s lawyer

Judge Susan Sullivan set bail low after Alvarez’s dangerousness hearing, which spanned several hearing dates this month. She said his lack of a criminal record and the low likelihood that he could flee contributed to her decision to deny the state’s request to keep him in custody.

She said the state had not made the “clear and convincing” legal case needed to deny his request for bail.

She agreed with Kelley that there are inconsistencies between the testimony of witnesses in the case and surveillance videos, including a video that shows the 15-year-old entering Alvarez’s room without any visible coercion and leaving 8 minutes later. Her clothing, hair and demeanor appear to be the same as when she entered his room.

A rape kit examined at South Shore Hospital the night of the police raid revealed male DNA. Prosecutors plan to request a DNA sample from Alvarez to compare with the accuser’s sample.

Alvarez will live in his girlfriend’s mother’s single-family home in Brockton.

He is allowed to leave the house for church services, legal and medical appointments, and job interviews. Judge Sullivan advised him to continue his Bible study and English classes remotely if possible.

He is no longer allowed to have any contact with the victim, who has since moved to an unknown address.

What the prosecutor told the police

The 15-year-old, who had been at the Rockland shelter with her father and his wife for just a few days, wanted to install WhatsApp on her tablet but couldn’t, her father said. His wife said she spoke to another guest who offered to take a look. That man, the father clarified in his statement, was not Alvarez.

The man was unable to help, and no details are available about how Alvarez, who was on the floor above the plaintiff, became involved in the situation. Kelley submitted a screenshot into evidence last week showing the plaintiff walking to the second floor with her tablet in hand.

The girl told police she ended up in Alvarez’s room. She said he asked her if she had a boyfriend before pushing her onto the bed and having forced sex with her.

Before the police were called at around 7 p.m., about four hours after the rape, the 15-year-old told her sister in Haiti what had happened. The sister told the girl’s father.

After someone called the police, the girl was briefly questioned and examined at the home before being taken to South Shore Hospital in Weymouth, where she was more thoroughly examined and questioned further.

Police then returned to the shelter and arrested Alvarez.
