PD man gets 20 years in prison and five lashes for raping teenage daughter

SEREMBAN: A 44-year-old man was sentenced to 20 years in prison and five strokes of the cane after pleading guilty to repeatedly raping his teenage daughter, who later gave birth.

The accused did not contest the charge after it was read out to him before Sessions Judge Mohamad Kamil Nizam on Wednesday (May 8).

“Even though you have pleaded guilty, the court must give public interest priority over personal interest.

“As a father, you should care for your child, but in this case you have betrayed him and caused him suffering and trauma.”

“The court also notes that Parliament has amended the law to provide for harsher punishments for such crimes,” said Judge Mohamad Kamil.

The accused was accused of committing the offense sometime in November 2022 at a house in Kg Pachitan, Port Dickson.

He was charged with incest under Section 376B(1) of the Penal Code, which carries a prison sentence of between 10 and 30 years and flogging upon conviction.

Judge Mohamad Kamil said the court also noted that the victim reported the matter to the police only after the defendant and his wife were jailed for a drug-related offense.

Deputy public prosecutor M. Kalaivaanan asked the court to impose a deterrent sentence as the accused repeatedly raped the victim until she gave birth to an illegitimate child in August last year.

He said the accused had been raping the girl since she was 12 years old.

“Although the defendant has pleaded guilty, this should not automatically be considered a mitigating factor.

“The court should also take note of the increasing number of incest cases and signal to the public that these crimes carry severe penalties,” he said.

Kalaivaanan also told the court that Parliament had amended the law twice to provide stricter punishments for such crimes.

In mitigation, the defendant pleaded for a lenient sentence because he had four children to care for and his wife suffered from diabetes and heart problems.

In another court, both the accused and his 45-year-old wife were accused of possessing Yaba pills weighing 32.8g at the same house on April 28.

The defendant pleaded guilty to the charge while his wife filed for trial.

They were charged under Section 12(2) of the Dangerous Drugs Act 1952, which carries a prison sentence of between five years and life imprisonment and not less than 10 lashes on conviction.

Sessions Judge Meor Sulaiman Ahmad Tarmizi then fixed July 4 for the trial after the prosecution informed him that the pharmacist’s report was not yet ready.
