Man sentenced to almost two years in prison for sexual assault

A man who assisted in his friend’s consensual sex with a Stafford teenager nearly seven years ago was sentenced to nearly two years in prison on Friday.

Seth Alexander Porter, 25, of Norfolk, was previously convicted in Stafford Circuit Court of aggravated sexual assault of an incapacitated person. He was sentenced to a total of 10 years in prison, with eight years and two months suspended.

The charges stem from an incident on August 7, 2017, at a gathering at a house in Stafford. Prosecutor Ed Lustig said Porter and German A. Munoz-Blanco picked up the girl and took her to the house, where she and several other people were drinking vodka in the garage.

The victim showed interest in Munoz-Blanco and began having sex with him in the backyard. At some point, according to prosecution evidence, Porter joined in.

The girl, who had also been drinking and smoking marijuana, claimed she was “not in her right mind” at the time, but said she never consented to have sex with Porter. She told her parents that night that she had been raped, and her father immediately took her to Mary Washington Hospital. When the girl was examined, Porter’s DNA was found.

Lustig said the victim immediately reported the incident to police, but the case was still pending in court for various reasons, including the COVID-19 pandemic.

After his arrest in 2021, Porter told Detective Brandon Boyle he was too high to remember what happened that night, according to court records. He was charged with additional offenses, but Lustig said he agreed to a plea deal, in part so the victim would not have to testify.

Porter later attempted to withdraw his Alford plea on the sole charge, but his motion was denied. Munoz-Blanco was convicted of aiding and abetting the crime and sentenced to six months in prison.
