Man convicted of sexual assault in his victim’s home

The court heard that Davidson sexually assaulted a woman in her home on September 20, 2020, after going there with the woman’s boyfriend.

The woman, her boyfriend and Davidson went into the woman’s bedroom to watch a movie.

The woman later asked Davidson to sleep on the couch, but he later returned to the bedroom and got into bed with the woman and her boyfriend.

As the woman tried to sleep, Davidson reached over her boyfriend, who was sleeping in the middle, and repeatedly touched the woman’s waist and arms, but she shook him off.

Between 9:00 and 9:30 a.m., Davidson abused the woman, who was now lying in the middle of the bed.

In shock, the woman rolled to the side and woke her friend.

Unable to tell her boyfriend what had happened, the woman told her roommate, who in turn told the woman’s boyfriend and told him to take Davidson home.

The court heard that Davidson repeatedly asked the woman’s boyfriend what had happened on the drive home and that he was shocked and cried when he was told.

The court was told that in a phone call to the woman in July 2021, Davidson claimed he had not attacked her, but at the end of the conversation he said he was sorry for what he had done and would not do it again.

When questioned by police, Davidson said he had drunk twelve beers and several vodka cruisers and taken an MDMA tablet the night before the incident.

He also told police that he “didn’t believe he did it” and that he “woke up in the morning and was told to leave.”

Davidson said the woman also told him not to tell anyone, but he had already told his partner.

In sentencing Davidson, Judge Peter Rozen said the defence had classified the sexual assault as “low to moderate” in comparison to similar crimes because it was opportunistic, required no planning, did not involve the use of weapons or photographs and did not involve the defendant being drugged. However, he accepted the prosecution’s view that the assault was “moderate”.

“It is important that she has let you into her home where she can feel safe,” said Judge Rozen.

The judge referred to the “profound and traumatic impact” the crime had on the victim’s life.

Judge Rozen also heard a statement from Davidson’s wife that he was aware that alcohol consumption played a major role in his behavior and that he had “changed his drinking habits” over the past four years.

Judge Rozen also discussed a clinical neuropsychologist’s report that found Davidson to be in the bottom ten percent of the population intellectually.

The judge concluded that Davidson had no past or future criminal record and was “unlikely to reoffend.”

Davidson was sentenced to two years probation and 200 hours of community service.

According to the order, he must undergo treatment for his mental health, drug and alcohol problems and participate in relapse reduction programs.

Judge Rozen ruled that up to 60 hours of time spent in treatment and rehabilitation programs could count as community service.

The judge said the key reason for deciding against a prison sentence was the fact that Davidson had indicated he was willing to plead guilty to the sexual assault charge in 2022. This would have allowed him to receive a reduced sentence because the court system was still in the Covid-19 era at the time.

“The court may not imprison an offender if the sentence imposed cannot be achieved through a term of imprisonment,” said Judge Rozen.

“The main advantage of a suspended sentence is that the court can impose further conditions.”
