Prisoner receives longer prison sentence for sexual abuse of a mentally disabled person

A former Albany man already facing life in prison was sentenced to an additional seven years in prison Friday for sexually abusing a mentally disabled person. Carl Barton, 58, was convicted in April of sexual assault and battery. According to the Albany County District Attorney’s Office, prosecutors said Barton had sex with a person who was incapable of consent on Nov. 30, 2020, at a Morris Street apartment.

A former Albany resident who was already facing life in prison was sentenced to an additional seven years in prison Friday for sexually abusing a mentally disabled person.

Carl Barton, 58, was convicted of sexual battery and sexual abuse in April. According to the Albany County District Attorney’s Office, prosecutors alleged that Barton had sex with a person who was incapable of consent at a Morris Street residence on Nov. 30, 2020.

This sentence will be served consecutively to a 30-year to life sentence that Barton is already serving for two previous convictions – 25 years to life for sexual abuse and 5 years for attempted illegal possession of a controlled substance.

Judge Roger McDonough had harsh words for Barton before announcing the verdict.

“He is clearly an individual who cannot function in society without trying or actually taking advantage of other members of society,” McDonough said.
