Judge dismisses sexual assault suit against Cowboys quarterback Dak Prescott

A Collin County District Court judge on Wednesday dismissed a sexual assault lawsuit against Cowboys quarterback Dak Prescott.

Judge Angela Tucker has scheduled a hearing for Sept. 13 to decide whether to impose sanctions against a Fort Worth woman who claimed Prescott sexually assaulted her in the parking lot of a Dallas strip club in 2017.

“Despite the tireless efforts of (the prosecutors) and their legal team to extort money and damage Dak’s reputation, justice has always prevailed and will continue to do so,” Prescott’s attorney Levi G. McCathern said in a statement to The Dallas Morning News.

Tucker ruled that the sexual assault was unfounded.

Prescott said the sex was consensual.

In February, the woman’s lawyers sent an email to Prescott demanding $100 million if he did not file or press charges related to a sexual assault, according to a court filing. Prescott responded on March 11 by filing and announcing a $100 million defamation lawsuit against the woman in Collin County. Prescott is additionally pursuing a criminal racketeering charge in Prosper, where he lives.

In response, the woman named Prescott as a defendant in a sexual assault lawsuit. The news does not usually name victims of sexual assault.

In May, Dallas police investigators said they had not found “sufficient evidence” to initiate criminal proceedings.

The plaintiff withdrew the lawsuit in Dallas County after the police made their decision and her attorney, Yoel Zehaie, planned to refile the lawsuit in Collin County.

Zehaie could not be reached for comment on Tucker’s decision.

“I know the truth,” Prescott said in April when asked about the lawsuit. “I’m confident in what we filed, very confident in what we filed. I know some things have changed in terms of the filings. But that doesn’t affect what we do and how we handle our lawsuit.”

Prescott could not be reached for comment Wednesday.

The criminal statute of limitations for sex crimes against adults in Texas varies depending on the severity of the offense. Under state law, the criminal statute of limitations for sexual assault against adults in Texas is ten years and the civil statute of limitations is five years.

“The original lies (by the plaintiff), her team, and her recent failed attempt to sue him civilly are all just a continuation of their blackmail scheme against Dak,” McCathern said. “These tricks distract from the trauma of legitimate victims of sexual violence and undermine the progress our society has made in supporting these victims. We are proud that Dak is standing up against this injustice and grateful that Judge Tucker agrees.”
