Rape convict: Court rejects gangster’s plea to stay conviction | Nagpur News

Nagpur: In a landmark judgment, Justice GA Sanap of the Nagpur bench of the Bombay High Court this week rejected a gangster’s plea seeking suspension of his sentence in a rape case pending disposal of his appeal. The court said that appellant Juned Khan had been convicted of a serious offence and also had a criminal record. The court also stressed that it could not accept the appellant’s plea that the conviction could certainly be converted into acquittal at a later stage. A court had sentenced Khan to 10 years’ imprisonment and a fine of Rs 50,000 for rape and also found him guilty of assault and threatening. The appellant’s lawyer argued that the rape victim’s statement did not match the medical evidence and the chances of his acquittal were high. The prosecution, represented by public prosecutor SV Kolhe, countered this on the ground that the victim’s statement was carefully and meticulously examined by the appellate court judge. The victim, represented by advocate Jitesh Duhilani, referred to the Supreme Court decision in Omprakash Sahni v. Jai Shankar Chaudhary to argue that the appellate court should not appreciate the evidence at the stage of pendency of appeal and should try to find out some gaps or loopholes in the evidence.
