A man who repeatedly had sex with his own mother and claimed he took advantage of her while she was drunk has been released.

The man, who cannot be named because his mother remained anonymous for life as a victim of a sexual offence, was cleared of raping his mother following a trial at Newcastle Crown Court. He pleaded guilty to two crimes: sexual intercourse with an adult relative.

Daniel Cordey, prosecuting, said the woman had been drinking heavily at the time of the crime. He added: “According to her, he started sexually exploiting her. She often binge drank and was very drunk. With this in mind, he also drank. He had sex with her at least five times.”

The Newcastle man was estranged from his mother as a child but reconnected with her after returning to the North East. ChronlicleLive reported that he was sentenced to two years in prison with rehabilitation and that he must sign the sex offenders register for five years.

Recorder David Gordon told him that people would be “disgusted at the thought of you having sex with your mother”. He added: “She didn’t raise you but that is in no way to excuse your behavior in this matter, which as I said will be off-putting to many, but this is not a morality court.”

The court found that the man was mentally unwell after his arrest and admitted to having sex with his mother during that time. He had also contacted his father on Facebook, asking him not to be angry and suggesting that he had sex with his mother.

The judge added: “You were on trial for rape and much more serious offenses and the jury acquitted you on both of those counts. You are remorseful, you are sorry for what you did. You lacked maturity back then.”

Christopher Knox, defending, said the man had grown up in “unfortunate circumstances” and was vulnerable. He added: “They were not mother and son in the traditional sense.” A person found guilty of sexual intercourse with an adult relative faces a prison sentence of not more than six months, the maximum statutory penalty, or both.
