Nick Carter claims it was “virtually impossible” to attack Shannon Ruth

Nick Carter has claimed it was “virtually impossible” for him to attack a sexual harassment accuser.

In documents filed in Nevada on Tuesday, May 7 and obtained by PEOPLE, the 44-year-old Backstreet Boys singer has filed a motion for a hearing and asked the court to grant him summary judgment on Shannon Ruth’s claims ” for sexual violence and intentional bodily harm, emotional distress and negligent infliction of emotional distress.”

The motion also names Melissa Schuman — a former teen pop singer with the girl group Dream who accused Carter of raping her in his Santa Monica apartment in 2003, when she was 18 and he was 22 — her father, Jerome Schuman, and @ElaineMoo Twitter account. YouTuber and former actress Alexa Nikolas was also summoned.

Ruth – who sued Carter for sexual harassment in December 2022 – claims she was assaulted as a teenager more than 20 years ago, an incident that a source close to the singer has denied.

“Ms. Ruth disagrees with much of the information contained in Mr. Carter’s motion for summary judgment,” her attorney Mark Boskovich told PEOPLE in an exclusive statement. “She looks forward to being able to express her point of view in her opposition.”

Ruth alleged that the then-21-year-old pop star sexually assaulted her on his tour bus when she was 17 after a concert at the Tacoma Dome in 2001, according to documents obtained by PEOPLE. TMZ and Rolling Stone were the first to report the lawsuit.

In the latest filing, Carter presents evidence disputing Ruth’s claim to security and band management and confirming that the Backstreet Boys made a “quick exit” after a concert where she allegedly waited in an autograph line. (The singer’s team claims that no such line existed.)

Susan Riggs, a friend of the band and Carter at the time, testified that she “personally observed Carter leave the venue, board his tour bus and immediately drive away” while Ashley Large, a fan, went to a meet-and-greet before the show, but claims there was no autograph session after the show.

Additionally, fans confirmed that Carter was immediately taken to the Four Seasons Hotel in Seattle shortly after the concert.

Carter’s lawyers claim that Ruth could not remember several details of the incident in question, including details about a drink called a “VIP drink” that she was allegedly served and the amount of time between getting off the bus and going to the bathroom. which she claimed was past being attacked and how Carter told her to “orally copulate” him.

The “As Long as You Love Me” singer also claims the accuser lied about giving her HPV and identifying his security guard who allegedly let him onto his tour bus. He also noted in the file that Ruth’s claims that she had been diagnosed with autism and cerebral palsy and was suffering were unsubstantiated.

Carter claims that Ruth was “coached and groomed” by Melissa and Jerome and that Ruth admitted on social media and in her statement that she was not sexually assaulted by the boy bander.

“Carter is entitled to summary judgment in this case and should not be forced to go to trial on a matter in which plaintiff has failed to provide even a shred of reliable evidence in support of her claims,” it said File.

The musician demands that Ruth’s “perjured statement” be ignored by the court.

“Based on the actual and substantial evidence, Carter did not rape Ruth, and her moving target story does not create a genuine state of affairs upon which a reasonable jury would return a verdict in her favor,” the motion states.

Since 2017, Carter has been accused of sexual assault by three women.

Schuman sued Nick in April 2023 for sexual assault and battery, while Ruth sued him in December 2022 for alleged sexual battery.

A source close to Nick denied the allegations.

In February 2023, Nick filed a countersuit against Ruth over her allegations and in that countersuit he also sued Schuman over the allegations she made against him.

The countersuit argued that the two women exploited the #MeToo movement and used it to launch a five-year conspiracy to “defame and disparage Carter and otherwise ruin his reputation in order to gain attention and fame.” and/or extort money from Carter.” ” PEOPLE’s lawsuit says.

Nick was sued by a third accuser who claimed he assaulted her in August 2023 when she was 15.

According to documents obtained by PEOPLE, he sexually assaulted her multiple times in 2003.

Carter’s lawyer denied the allegations.
