New York judge suspended over drunk driving charges

A New York judge who was arrested for allegedly driving while under the influence of alcohol with a child in her car has been suspended with pay.

The New York State Court of Appeals on Thursday suspended Judge Julie Kuck of Lindley Town on charges of driving while under the influence of alcohol with a child under 15, a felony. She is also charged with driving while under the influence of alcohol and operating a motor vehicle with a blood alcohol content of over 0.08%.

According to Law.com, the charges stem from a traffic stop on June 14.

Robert Tembeckjian, administrator and counsel to the New York State Commission on Judicial Conduct, recommended that Kuck be suspended while retaining his salary until the criminal charges are resolved.

In a letter sent to the appeals court on Friday, Tembeckjian said the commission “makes no comment on the merits of the pending criminal charges against Kuck and recognizes that she, like any defendant, is presumed innocent.”

However, Tembeckjian also said that public confidence in the judiciary and the legal system would be undermined if Kuck continued to serve in one court while simultaneously having to defend herself against serious allegations in another court.

“The Commission notes that while it is rare in this State for a judge or judicial officer to be charged with a serious crime, it is the Court’s standard practice in such cases to suspend the accused from judicial office with salary while the charges are pending, and to do so with the presumption of innocence,” Tembeckjian wrote.

Kuck, whose term ends in December 2025, did not respond to the ABA Journal’s request for comment.
