Subway worker recovering in intensive care after Brooklyn train crash

BROOKLYN, NEW YORK (July 27, 2024) – A subway worker was seriously injured in a train crash in Brooklyn near the Hoyt-Schermerhorn Streets station.

According to New York authorities, the incident occurred early Thursday. A 64-year-old worker was struck by an out-of-service F train and suffered a serious head injury.

Firefighters and paramedics were called to the scene to assist the worker. He was taken to Bellevue Hospital where he was listed in critical condition.

The comprehensive investigation is currently still ongoing.

Liability for subway accidents in Brooklyn

Despite many annual improvements in workplace safety standards, far too many people are seriously injured or killed while performing their jobs. According to the National Safety Council, “the number of preventable workplace deaths increased 5% in 2022, totaling 4,695. In addition to preventable workplace fatalities, there were 791 workplace homicides and suicides in 2022. These intentional injuries are not included in the estimates of preventable injuries.” Metro companies should take a number of steps to ensure the safety of their employees.

  • Agencies should conduct regular risk assessments to identify potential hazards.
  • Agencies should maintain clear lines of communication between all workers and conductors on work projects.
  • Agencies should provide their employees with comprehensive training on security protocols.

Depending on the circumstances of the case, there can be numerous sources of liability in a subway accident. A general contractor could be held liable under New York Labor Law 200. General contractors are required by law to keep workplaces in a reasonably safe condition. If a general contractor has actual or constructive knowledge of a dangerous condition and fails to take action, it can form the basis for a negligence claim. It is important that certain steps are taken after a subway accident.

  • Eyewitnesses should be questioned.
  • Medical records should be kept.
  • A search should be carried out for surveillance material.
  • A thorough investigation should be carried out.

Many workplace accidents are preventable. They are much more likely to occur in workplaces that do not have a culture of safety and worker protection. In particular, many companies and government agencies have implemented cost-cutting measures that increase the likelihood of workplace accidents. Anyone injured in a subway accident can pursue legal action through a civil lawsuit. A personal injury attorney can review all of the particular facts of your case and advise you of your legal options.
