Family of man killed in plane crash near Dayton airport files wrongful death lawsuit, seeking at least $10 million – WHIO TV 7 and WHIO Radio

DAYTON – The family of a man who died in a car crash near Dayton International Airport in April has sued the man accused of causing the accident and the company that owned his car.

Richard Turnbull’s family is seeking $10 million in compensatory damages and at least $25,000 in punitive damages from Clayton Hughes and Benchmar Industrial Inc., according to a wrongful death lawsuit filed April 22.

As News Center 7 previously reported, Turnbull was one of four people killed in a plane crash near Dayton International Airport on April 1.

An investigation by the Ohio State Highway Patrol revealed that a Volvo driven by Clayton Hughes (26) collided with a Chrysler Pacifica driven by Larry Edwards (77), who attempted to turn left at the intersection.

Edwards and three people in his car – Stephen Cassel, 72, Richard Coatney, 77, and Turnbull, 66 – succumbed to their injuries at the scene of the accident.

According to an Ohio State Highway Patrol accident report, Hughes’ blood alcohol level at the time of the accident was .224.

No criminal charges were filed against Hughes.

The lawsuit alleges that Benchmark Industrial Inc., the owner of Hughes’ car, “negligently entrusted the vehicle to an incompetent driver.”

It also alleges that Hughes’ actions were “intentional, wanton and reckless.”

A motion to reschedule the hearing states that the families of the other people involved in the accident have sought legal counsel and could also file a lawsuit.

However, it is unclear when these additional lawsuits would be filed, the court document says.
