Mumbai: “Two people lost their lives. There was trauma but the child (the youth in conflict with the law) was also traumatised. Give him some time,” said Justice Bharti Dangre and Justice Manjusha Deshpande of the Bombay High Court while hearing a petition against his “illegal detention” following “public pressure”. The teenager was allegedly speeding in the luxury car in Pune on May 19 in an inebriated state when the car collided with a motorcycle, killing two software engineers, Aneesh Awadhiya and Ashwini Koshta. The HC on Friday withdrew a habeas corpus petition filed by the minor’s Delhi-based paternal aunt on the court’s direction, seeking his release from alleged illegal detention, three days after he was granted bail. Last Friday, the court had rejected the plea seeking immediate relief. Senior family lawyer Aabad Ponda said the court must examine whether a child who has been released on bail and remains on bail can be sent to an observation home as this is expressly prohibited under the Juvenile Justice Act. The court will pass orders to this effect on June 25. Till then, the teenager will be sent to an observation home in Pune.
