Sexual assault: Man gets 20 years in prison for sexually assaulting a five-year-old girl | Mumbai News

Mumbai: A 62-year-old has been sentenced to 20 years of penal servitude for sexually abusing a 5-year-old girl in 2022. The child was playing outside with a friend when the accused offered her a soft drink and took her to a secluded place. The judge said the victim’s oral statement is corroborated by that of her mother, who, after learning about the incident, rushed to the scene, saw the accused and approached the police. “Considering the victim’s oral statement, particularly the fact that she has firmly answered the questions posed to her in her main and cross-examination and the manner in which she has narrated the incident…, it does not appear that the victim was instructed to testify to any particular facts… I see no reason to discard the victim’s statement…” the judge said. The victim stated that on October 25, 2022, she was playing near a temple located some distance from her house. An uncle came out of his house and sat next to her. She thought he was going somewhere else and might be tired, so he remained sitting there. When she got up, he allowed her to get up and held her hand tightly. Her friend went to tell her mother. In her friend’s absence, she was sexually abused by the accused. When her friend returned with her parents, the accused let her go. The victim was in pain and ran towards her mother. Her mother went to the accused and abused him. Someone called the police and they took her to the doctor. The accused was arrested. The accused denied the allegations and said that the evidence on record was highly improbable and unbelievable. He further added that the mother had clearly expressed in her cross-examination that she did not want to pursue the case further, which led to the conclusion that the case was false. “…The victim has clearly admitted in cross-examination that her aunt told her what to say in court…” the accused claimed.
