Rape: Guard sentenced to 30 years in prison for raping 4-year-old girl | Rajkot News

Rajkot: A special POCSO court in Jamnagar sentenced 35-year-old security guard Sarjan Vishwakarma to 30 years in prison for abducting and raping a four-year-old girl in January 2023. The court also ordered the state government to pay compensation to the young survivor under the Gujarat Victims Compensation Scheme 2019. Delivering the verdict, Deputy District Judge and Special POCSO Judge Madhvi Bhatt highlighted the gravity of the crime and said that “the accused had abused the trust of the little girl who considered him as her uncle”. Vishwakarma was sentenced to five years’ imprisonment and a fine of Rs 1,000 under Section 363 of the Indian Penal Code (IPC) and 30 years’ imprisonment and a fine of Rs 5,000 under Section 4(2) of the POCSO Act, 2012. The sentences will be served concurrently, according to public prosecutor JK Bhandari. The incident took place on January 1, 2023, when Vishwakarma lured the girl with chocolate and took her to a remote area near Neelkamal Society, where he sexually abused her and inflicted injuries on her private parts. After committing the crime, he left the girl on the road and fled the scene. The girl returned home crying and informed her mother, following which her father filed a complaint at Jamnagar C Division police station. The police registered a case under various sections of the IPC and POCSO Act and during the investigation, key evidence was collected including the statement of the girl, medical samples and CCTV footage showing the accused with the girl. In court, Vishwakarma maintained his innocence and claimed that the evidence against him was fabricated. However, the prosecution argued that the CCTV footage and statements of the survivors, her parents and all the witnesses supported the facts of the case. During the sentence hearing, which the accused attended via video conferencing from Jamnagar district jail, he sought mitigation, citing his responsibility of four daughters and claiming to have been drunk at the time of the incident. The court considered the young age of the girl and the breach of trust by the accused, whom she considered as an uncle. Considering the age, family responsibilities and socio-economic status of the accused, the court imposed appropriate punishment. Investigating officer PL Vaghela noted that both the victim’s father and the accused worked as security guards and that the police had collected electronic evidence and other relevant documents and filed the chargesheet within five days of registering the case.
