Online shoppers often receive notices about cookies that track and analyze a person’s browsing behavior and activities. However, many websites fail to warn their users about another type of stealthy data collection: pixel tracking.

Outdoor sporting goods retailer Columbia allegedly collected information about its website users and transmitted it to PayPal in a way that compromised users’ privacy. Residents of California, Florida, Washington, Pennsylvania, or Massachusetts whose data was collected without their consent through the PayPal pixel may qualify to participate in this privacy investigation.

What are tracking pixels?

Web beacon are tiny, transparent images embedded in web pages, emails or ads to collect data about user behavior and interactions. This data is then shared with third parties for various purposes, including retargeting, conversion tracking or personalizing the user experience.

One of the biggest concerns surrounding pixels is that they track users without their consent. These privacy concerns are prompting an increasing number of class action lawsuits. Some are advocating for laws that require companies to inform visitors about the presence of tracking pixels and the data collected. Others argue that users should have the ability to opt out of tracking pixels if they so choose.

An investigation is currently underway into a potential lawsuit against Columbia Sportswear for allegedly using the PayPal tracking pixel without user consent. The investigation is focused on residents of five states: California, Washington, Pennsylvania, Florida, and Massachusetts.
