A Ferndale man accused of possessing burglary tools and peering into a window in Warren has been found mentally incompetent and will be referred to probate court.

That charge and a resisting arrest charge against 58-year-old Kenton C. Driscoll were recently dismissed by Judge Michael Chupa of the 37th District Court in Warren after state psychologists determined he did not understand and do not understand the charges against him contributing to his defense was his lawyer, Saleema Goodman-Sheikh, who said the case showed how mental health issues in many criminal cases “really permeate these defendants.”

Driscoll will be subject to a civil commitment in probate court, which will be reviewed every 90 days, Goodman-Sheikh said. If he is released, the charges could be refiled, she added.

Driscoll was arrested in October 2022 after a report of a suspicious man near 11 Mile and Ryan streets, and Warren officers initiated a surveillance operation, police said. Driscoll noticed the officers and fled on his bicycle, but was captured after a short pursuit, police said.

Officials at the time reported that he had been convicted of mischief several times, including in Warren. Records do not show prior convictions, but convictions are hidden from public view after seven years.

Driscoll was subsequently determined to be incompetent to stand trial. Psychologists then had 15 months to try to get him competent again, otherwise the charges would have to be dismissed.

In 2012, a conservatorship was filed for Driscoll, who was listed as a “ward” according to Oakland County Probate Court records.
