Concertgoer sues Madonna for alleged “sexual acts” during live performances

Madonna is facing a new lawsuit in connection with her Celebration Tour.

On May 30, Justen Lipeles filed a class action lawsuit against the singer in a Los Angeles court over her March 7 performance at the Kia Forum in Inglewood.

Lipeles alleges negligent misrepresentation, intentional infliction of emotional distress, misleading advertising, and breach of a written contract.

According to court documents obtained by PEOPLE, the singer claims in the lawsuit that she exposed audience members to pornography “without warning,” including topless women simulating sexual acts on stage.

Lipeles’ lawyers at Lipeles Law Group said he brought his 11-year-old sister to the show and was “shocked.”

“Imagine taking your 11-year-old daughter to a pop concert,” reads the statement, obtained by Entertainment Tonight. “During the concert, the women on stage take off their tops and go completely topless. They then begin to act out sexual situations, including cunnilingus and digital penetration, as well as other pornographic situations. This is done without any warning to anyone who may feel offended by this type of content, especially those who bring children to the concert.”

The lawsuit alleges that the singer and Live Nation “tricked” fans into buying “expensive tickets” for her Celebration Tour and “intentionally and misleadingly” withheld information when marketing the shows.

The plaintiff claimed that the “Material Girl” turned off the air conditioning and Lipeless became ill in the heat.

“For many hours, everyone was forced to sit in a sort of sauna,” the statement continued. “This was no accident, Madonna insisted that the air conditioning remained off and when people in the crowd complained, she said she would not turn the air conditioning on and if they didn’t like it, they should take off their clothes. People were physically uncomfortable and sweating like crazy. In other words, people paid thousands of dollars to sit and suffer without warning while watching live porn, including children.”

He also claimed that Madonna did not sing her songs live, but that they were lip-synced.

As in many other lawsuits against the singer, Lipeles cited Madonna’s lateness. The show was scheduled to start at 8:30 p.m., but she did not take the stage until 10:00 p.m.

Lipeles also named Forum Entertainment, Kia Forum, Acrisure Arena, Golden 1 Center and Chase Center in the lawsuit.

The lawsuit also named other venues in California, as the plaintiff claimed the singer was late for all of her performances in the Golden State, ET reported.

The plaintiff’s lawyers stated that they were “in the process of making minor amendments to the complaint.”

There has been no response to this new lawsuit so far, but in the past the star’s legal team filed a motion to dismiss the lawsuit on the grounds that “no reasonable concertgoer would expect the headliner to take the stage at the stated time.”

In January, some fans in New York filed a lawsuit against Madonna because her show at the Barclays Center in Brooklyn started late.
