Press Releases – BCA identifies officers who used force in Bloomington incident

ST. PAUL – The Minnesota Department of Public Safety’s Bureau of Criminal Apprehension (BCA) has identified the Richfield police officers who used force in the July 5 incident in Bloomington.

  • Carter Johns fired his service rifle. He has 10 months of police experience and is on critical incident leave.

  • Bryan Rosas fired his service weapon and used less-lethal force. He has four and a half years of law enforcement experience and is on critical incident leave.

  • Sergeant Patrick Sheady used less-lethal force. He has 10 years of experience in law enforcement.

According to the preliminary investigation, just after midnight on July 5, Richfield officers responded to a call from a suicidal Bloomington man. The man, later identified as Andrew James Maxwell, 36, of Bloomington, said he was in the garage and had a shotgun. When officers arrived at the home, they saw the garage door begin to open and Maxwell come out with a shotgun in his hand. Rosas fired non-lethal shots at him and Maxwell fired at the officers. Johns and Rosas then returned fire. No one was injured in the exchange of gunfire. Maxwell then went back into the garage and closed the door. The Richfield SWAT team responded and at some point Sergeant Sheady fired 40mm rounds at Maxwell. When he exited the garage, officers arrested him. Maxwell was transported to the Bloomington Police Department, where he was examined by medical personnel and cleared of liability while awaiting arraignment.

BCA crime scene personnel recovered bullet casings and shotgun shells at the scene. Both body-worn and patrol car camera video exists from this incident. BCA agents are reviewing all available video as part of the ongoing investigation.

The Richfield Police Department has asked the BCA to investigate this incident. Once the investigation is complete, the BCA will submit its findings, without a recommendation of charges, to the Hennepin County District Attorney’s Office for review.
