Man on probation arrested for possession of firearms, including AR pistol and Glock “Switch”

GAINESVILLE, Fla. – 19-year-old Xavier Lamarious Kellogg was arrested on June 27 for violating his probation and charged the next day with two counts of possession of a firearm by a convicted felon under 24 years of age.

Kellogg has been on probation since May 2022 after pleading nolo contendere (no admission of guilt) to attempted aggravated assault with a deadly weapon and possession of a firearm by a convicted felon and being sentenced as a youthful offender to two years of home confinement followed by four years of probation by Judge Phillip Pena, who declined to enter a guilty plea.

Kellogg had already violated his probation three times and served a prison sentence after the second violation earlier this year. However, a month after his release, he violated probation again by failing to attend mental health treatment sessions.

On June 27, probation officers reportedly went to his apartment to conduct a search without a warrant after viewing a video of Kellogg handling two firearms. Gainesville Police Department (GPD) officers accompanied them but remained outside the apartment.

Probation officers allegedly found a firearm, took a photograph of it, and notified GPD officers, who obtained a search warrant for the residence. Probation officers also turned Kellogg over to GPD officers, who took him into custody for a probation violation.

When the search warrant was executed, officers reportedly found an AR pistol, two loaded AR magazines, a .45 bullet, a .40 bullet, gun accessories, and a Glock “switch” that makes a pistol fully automatic. All of the items were reportedly found in Kellogg’s bedroom, near his wallet, identification, and papers in his name.

Kellogg was convicted of auto theft at age 14 and charged as an adult at age 16 after he was arrested in connection with a February 2022 shooting at the Pavilion on 62nd Apartments. In addition to the recent charges, his probation officer reported that he gave false information to the probation officer about which room he was staying in and that he was behind on monthly court costs of $467.43.

Kellogg is currently being held without bail on a probation violation charge. Judge Jonathan Ramsey set bail for the new charges at $125,000.
