David Koechner’s wife asks the court to deprive him of visitation rights to their children after his arrest for drunk driving on New Year’s Eve

David Koechner’s estranged wife Leigh Koechner doesn’t want him to be near their children after he was arrested for drunk driving on New Year’s Eve.

Leigh, 55, asked the Los Angeles Superior Court on Friday in documents obtained by PEOPLE to stay the Host The actor had denied visitation rights to the children and asked that “safety measures be taken to ensure (Koechner’s) sobriety.”

Safety precautions include him undergoing drug testing and using a Soberlink device to monitor his alcohol consumption.

In response to his wife’s request, David, 59, stated in documents obtained by PEOPLE that he wants to continue to have shared custody with Leigh, noting that none of their five children were in the car at the time of his drunk driving incident and that he is currently seeking professional help to get sober.

“My recent arrest for alleged drunk driving did not occur while one of our children was in my care,” he wrote, adding, “There is nothing urgent that this court needs to address ex parte. I am a member of AA and have a sponsor and I would never do anything to jeopardize the health and safety of our children.”

The Goldberg’s The actor also provided a screenshot of a text message which he said showed that Leigh had asked him to drive her 15-year-old son Sargent to the airport since his arrest.

He and Leigh married in 1998 and filed for divorce last January.

David was arrested last Friday at 3 p.m. local time in Simi Valley, California, on charges of drunken driving and hit-and-run after allegedly striking a street sign with his car. He was released around 6 a.m. Saturday and is scheduled to appear in Ventura County Superior Court on Wednesday, March 30.

Representatives for David did not immediately respond to PEOPLE’s request for comment.
