Court sentences man to 12 years in prison for kidnapping and raping his underage niece

New Delhi (India), June 18 (ANI): The Rohini Court in Delhi has sentenced a man to 12 years in prison for kidnapping and raping his minor niece.
This case relates to an FIR filed at Ashok Vihar police station in 2017.
The court stated that the claim that children are safest around family members and acquaintances has been shown to be a myth, as persons like the convict have committed such heinous crimes against children of their own family – and in this case, his niece.
Special (POCSO) Sushil Bala Dagar sentenced the convict to 12 years of imprisonment under Section 6 of the POCSO Act on June 5.
The court also sentenced him to ten years’ imprisonment for the offence under Section 366 (abduction, abduction or inducement of woman to marry) and seven years’ imprisonment for the offence under Section 363 (kidnapping) IPC.

The court also imposed a total fine of Rs 65,000 for all the offences.
The court awarded compensation of Rs 1,050,000 to the victim, a 24-year-old married woman with three children.
The court stated: “The victim was the victim of a serious sexual assault with penetration as well as psychological and physical trauma. As a result of the incident, not only the victim but also her entire family was humiliated and insulted by society. The incident had a serious impact on her psychological, physical and emotional well-being for which she requires financial support.”
“Home is considered to be the safest place in the world for children. People in a shared household are considered to be the most trustworthy people. But with the increase in crimes against women, crimes against children in the form of incestuous rape have also come to light,” the court said in a ruling issued on June 5.
It continues: “Children are victims of sexual assault by family members, relatives, teachers, acquaintances, etc. Although they are innocent for their age, boys and girls are abused. If there is a sex offender in the family, who will protect them?”
The court clarified that it is the responsibility of the society as a whole to take care of its children and protect them from physiological and psychological exploitation by sexual predators. Today’s children are the future of society. The interests of the vulnerable child must be protected to create a healthy, developed and vibrant society. (ANI)
