'Very serious offence': Noida businessman sentenced to ten years in prison for sexually abusing a schoolgirl

A local court in Noida sentenced a businessman to 10 years in prison for kidnapping and sexually abusing his minor neighbour. The convict was also fined Rs 30,000. He was convicted under sections of the IPC and the POCSO Act.

Noida: A local court has sentenced a Noida-based businessman to 10 years in prison for kidnapping and sexually assaulting his minor neighbour three years ago. The accused was identified as Prashant Kumar and was fined Rs 30,000.

The then 14-year-old minor, a student of Class 9, was allegedly lured away by Kumar in April 2021, following which her father approached the local Expressway police station to lodge a complaint, which led to the filing of the FIR and the arrest of the convict.

According to a PTI report, in an order passed on Saturday, the court convicted Kumar under Section 366 of the Indian Penal Code (IPC) for abducting or carrying off a woman to compel her to marry or have illicit sexual intercourse and under Section 4 of the Protection of Children from Sexual Offences (POCSO) Act for penetrative sexual assault of a child.

Advocate Dharmendra Pal, representing the accused, demanded a minimum sentence as he is the sole breadwinner of his family and has no criminal record other than that. However, Special Public Prosecutor Jai Prakash Bhati argued that the convict has committed a “very serious offence” and does not deserve any leniency from the court. He also ordered that the accused Prashant Kumar be sentenced to 10 years’ imprisonment and a fine of Rs 20,000 under Section 4 of the POCSO Act and that in case of default of payment of the fine, the convict shall be given an additional simple imprisonment of six months.

The order further states that the accused is also sentenced to imprisonment for a term of three years and to pay a fine of Rs 10,000 for violating Section 366 of the IMPC. In case of non-payment of the fine, the convict will also have to undergo simple imprisonment for a term of one month.
