Endicott man falls asleep at the wheel and is arrested for drug and gun possession

BINGHAMTON, NY (WIVT/WBGH) — A 20-year-old man was arrested on weapons and drug charges on July 4 after falling asleep at the wheel in Binghamton.

According to police, patrol officers found a running but motionless car on the road near the corner of State Street and Dennison Avenue around 6 p.m. on July 4. Officers stopped to examine the car and found a man “slumped over the steering wheel.”


The patrol officer was able to awaken the man and speak with Lavar McDaniel, 20, of Endicott. McDaniel had a warrant out for his arrest for a probation violation in Broome County and was taken into custody.

When the police searched the car, they found a loaded Glock 26 9mm pistol, over 80 grams of meth, almost seven grams of cocaine, over eight grams of fentanyl, about six oxycodone tablets and $500 in cash. Weighing and packaging materials were also found in the car.

In addition to the arrest warrant, McDaniel was charged with:

  • Criminal Possession of a Controlled Substance 2and Grade – Class A-II Serious Felony
  • Criminal Possession of a Controlled Substance 3rd Degree (5 counts) – Class B felony
  • Criminal Possession of a Controlled Substance 4th Grade – Class C felony
  • Criminal Possession of a Controlled Substance 5th Grade – Class D Felony
  • Criminal possession of weapons 2and Grade – Class C felony
  • Criminal possession of weapons 3rd Degree (2 counts) – Class D Felony
  • Criminal Possession of a Firearm – Class E Felony
  • Criminal use of drug paraphernalia 2and Degree (2 counts) – Class A misdemeanor
