Girl allegedly attacked by dog agrees to 115,000 euros

The High Court has agreed to a settlement of 115,000 euros in the case of a toddler who was allegedly attacked by a golden retriever four years ago.

The court heard that Mia Kate Nolan was 19 months old and walking near her home when the dog allegedly came from behind, bit her head and then knocked her over and shook her.

It is alleged that the dog held her face down while her mother kicked and punched him to make him let go of her daughter.

She was admitted to a local hospital and then transferred to a Dublin hospital, where she remained for five days following surgery for scalp injuries.

She had scars on her scalp and upper neck, but a plastic surgeon’s report stated that all scars had healed and no further surgery was necessary.

The now five-year-old from Kilclooney, Ballinasloe, Co Galway, filed a lawsuit through her mother Leslie Nolan against the dog’s owners Declan and Ann O’Grady, also from Kilclooney, Ballinasloe.

It was alleged that the dog was not properly controlled or restrained, although the owners allegedly knew or should have known that the dog had a tendency to attack or bite people near the O’Gradys’ home.

It was also alleged that passers-by were not warned about the dog, nor was it muzzled or trained to do so, in order to minimise the risk it posed.

Judge Nuala Jackson approved the agreement.
