Driver sued for negligence after traffic accident on Shamrock Road

According to a Grand Court summons dated June 14, 2024, the driver of a Ford Fiesta is suing the uninsured driver of a Toyota Rav4 for damages of an unspecified amount. The Ford Fiesta driver claims the damages relate to an accident caused by the negligence of the Toyota Rav4 driver.

According to the statement of claim, on April 14, 2023, the driver of the Ford Fiesta was driving along Shamrock Road approaching the Grand Harbour roundabout. As he approached the Grand Harbour roundabout, the driver of the Ford Fiesta stopped when the driver of the Toyota Rav4 allegedly collided with the rear of the Ford Fiesta.

According to reports, the driver of the Ford Fiesta “was taken by ambulance to George Town Hospital complaining of pain in her right ankle and the back of her head.”

The complaint further states:

After the accident, she visited her family doctor and complained of neck and shoulder pain.

She was prescribed medication.

She was referred for physiotherapy and underwent a course of physiotherapy.

To explain the alleged losses beyond her injuries, the complaint states that she “suffered damages and incurred expenses as a result of the accident” and that the damages include “but are not limited to claims for loss of income, loss of medical treatment, travel expenses, equipment and unpaid nursing care.”

The complaint further alleges that the Toyota Rav4 was negligent because the driver “failed to pay attention or did not pay attention properly, did not see the plaintiff’s vehicle or did not see it in time, did not brake or did not brake in time, and did not steer or control his vehicle in a manner that would avoid the said collision.”

In addition to the general and special damages for the above, the driver of the Ford Fiesta is seeking reimbursement of costs and any other compensation or damages that the court may deem appropriate.
