G Noida: Man gets 10 years in prison for raping his niece in 2015

Greater Noida: A 28-year-old man has been sentenced to 10 years in prison for raping his distant relative from a village in Greater Noida in 2015. The victim called him “mama” (maternal uncle), public prosecutor’s office officials told HT on Friday.

The court was told that the then 19-year-old man allegedly took the then 16-year-old girl from Surajpur to Bhangel village in Noida in 2015 and raped her for three days before the police rescued her and arrested him, the court order said.

JP Bhati, Deputy District Government Advisor (ADGC), said that the victim’s paternal uncle had filed an initial complaint with Surajpur police station on May 4, 2015.

“On May 3, the accused kidnapped the victim from Surajpur and committed the crime. The police have filed charges of rape and kidnapping under the Indian Penal Code against the accused and launched a manhunt,” he said.

Three days later, the police found the victim and the suspect near his house in Bhangel. The minor girl was then taken to the district hospital for medical examination and the suspect was remanded in custody.

The victim stated in court that the defendant was a distant uncle on her mother’s side.

“He often visited our house and often persuaded me to marry him. That day, he carried me through the street. I was against it. But he asked me to keep quiet and said we would return soon. Then he took me in a car to his house in Bhangel, where he raped me for three days. On May 7, when he was taking me somewhere, the police rescued me and arrested him,” she told the court.

A witness, a local resident, also told the court that he saw the suspect and the victim riding together in a car that day.

Dr. Preeti Agarwal, who conducted the examination of the victim, stated in her court statement that there were no external injuries visible on the body. “The victim had refused to undergo an internal examination,” she said in her statement.

Chandrapal Singh, the accused’s lawyer, argued that his client had been set up in this case and deserved an acquittal.

However, Vikas Nagar, Additional Sessions Judge, relied on the statements of the prosecution witnesses and convicted the accused.

The man (name withheld) “is sentenced to 10 years imprisonment and a fine 20,000 under Section 4 of the POCSO Act and three years imprisonment and 10,000 fine under Section 366 (abduction or kidnapping of woman with intent to compel her to marry) of the IPC,” the court said.
