The case of child molester Dylan Lloyd, who sexually abused a girl on a train in Adelaide, will be referred to a higher court

Prosecutors have successfully applied to have the case of Dylan Lloyd, who sexually assaulted a 12-year-old girl on a train in Adelaide’s south, referred to the state’s highest court.

Lloyd, 22, pleaded guilty in Adelaide District Court in February to unlawful sexual intercourse with a person under the age of 14 and indecent assault.

Prosecutors have asked for the case to be referred to the Supreme Court, which involves a law that applies to offenders who cannot or will not control their sexual urges.

Lloyd abused the girl in January as they travelled by train to Seaford.

Police previously stated that Lloyd attempted to follow the victim, who was walking alone, before a third person called police.

On Friday, the district court heard a motion by prosecutors to have Lloyd’s case moved to the Supreme Court, and Judge Anthony Allen granted the motion.

Under relevant legislation, the Supreme Court may order that offenders who are unable or unwilling to control their sexual urges be remanded in custody until further notice.

“I am of the opinion that the defendant should be treated in accordance with the (law),” Judge Allen said.

“Instead of convicting the accused myself, I will remand the prisoner in custody and send him to the Supreme Court for trial.”

The legislation also states that Before an order can be made for the continued detention of the prisoner, the Supreme Court must order at least two doctors to examine the prisoner’s mental condition and report to the court whether the person can control his or her sexual urges.

Lloyd’s defence lawyer Andrew Williams, who told the court that his client suffers from severe autism, also said Lloyd was charged with “breach of bail conditions”.

“This breach will be admitted in due course,” Lloyd’s lawyer told the court.

The offence is related to bail posted following charges of aggravated sexual assault committed by Lloyd in Oaklands Park in August 2021.

The case will return to the Supreme Court in July.
