Fani Willis suggests she won’t testify in ‘unlawful’ Georgia Senate investigation

District Attorney Fani Willis of Fulton County, Georgia, said the Senate’s investigation into her was “unlawful” and indicated she would not comply with a Senate subpoena.

“Well, first of all, I don’t even think they have the authority to subpoena me, but they need to familiarize themselves with the law,” Willis said after being asked if she would appear before a Georgia Senate committee without being asked to do so by a subpoena .

When a reporter pressed her, asking “yes or no” whether she would appear, Willis said, “I will not appear at anything that is unlawful.”

The district attorney’s responses were prompted by the committee chairman, Republican Bill Cowsert, and his alleged assertion that he would subpoena her if she did not appear alone.

In January, a Republican-led Georgia Senate investigative committee was created to investigate whether Willis misused taxpayer funds in her impeachment of former President Trump and others on racketeering allegations.

After a recent committee hearing, Cowsert told WSB-TV Channel 2 Atlanta’s Richard Elliot, “If she’s not willing to come and explain her behavior, we’re going to subpoena her and ask her to come and require her to that she comes.”

“I have not broken the law in any way,” Willis told reporters at a news conference this week. “I’m sorry that people are upset because everyone is treated the same.”

Fox News Digital’s inquiries to the attorney general’s office and the Georgia Senate press office for Cowsert did not immediately receive a response.

Trump was first charged in August 2023 in the Fulton County case along with 18 others under Georgia’s Racketeer Influenced and Corrupt Organizations Act for alleged actions as part of a plot to overturn the 2020 election results.

Earlier this year, it was discovered that Willis was romantically involved with Nathan Wade, the special prosecutor she hired to take on the case. Ultimately, Wade resigned from the case after the judge ruled that there was no reason to disqualify Willis, but that she could only remain on the case without Wade.

Trump’s legal team has since appealed the judge’s decision that they could continue to work on the case.
