Police were contacted in March by the victim and her mother, who reported that the victim, when she was between the ages of four and six, had been assaulted by Upton at his East Main Street apartment in Youngsville, according to a probable cause affidavit filed in the case.

During an interview, the victim first described in detail the psychological and physical abuse by Upton.

“She described how (Upton) made (her) climb into the washing machine, close the lid and threaten to turn the washing machine on if she tried to get out,” says the affidavit.

Upton is also said to have forced her and her younger brother into dog crates and forced them to “charged traps used on animals and placed on their feet.”

“The victim was instructed by (Upton) to put a leather belt around her younger brother while he was sleeping and to strangle him,” says the affidavit. “She refused to do it.”

She also told authorities that Upton allegedly forced her to eat hot dogs and made her vomit “And he forced them to eat the vomit.”

The victim then described cases of sexual assault “several times” These included Upton’s attacks on her and her brother, as well as forced oral sex and viewing pornography.

The affidavit states that Upton “threatened to kill her and her brother if she ever told anyone about the abuse,” He threatened her in particular with martial arts swords and told her that he would “Let your mother watch too.”

In connection with these allegations, police charged Upton with a range of crimes: sexual assault, six counts of forcible deviant sexual intercourse, sexual assault, four counts of aggravated sexual assault, three counts of sexual assault, four counts of seduction of a minor, three counts of endangering the welfare of a child, and terroristic threats.

Upton is currently being held at the state correctional facility in Albion. According to online court records, he was convicted of a similar offense in 2015. The charges against him carry a sentence of 120 to 240 months in prison.
