German court upholds hate speech conviction of politician who warned women about rape by immigrants

A conservative German politician has been convicted of “incitement to hatred” after she warned women about gang rape by Middle Eastern immigrants in a social media post.

According to the European Conservatives website, an appeals court on Tuesday upheld the conviction of Marie-Thérèse Kaiser, a leader of Germany’s conservative AfD party. The court’s decision maintained a fine of around $6,500 for Kaiser.

The European Conservative reported that the case dates back to August 2021.

At that time, Kaiser spoke out on social media after the left-wing First Mayor of Hamburg, Peter Tschentscher, announced that the city would accept 200 immigrants from Afghanistan.

She warned of “culturally alien masses” raping German women.

In her social media post, Kaiser wrote: “Afghanistan refugees; Hamburg SPD mayor for “unbureaucratic” acceptance; Welcoming culture for gang rape?”

As the European Conservatives reported, Kaiser also “linked to an article showing that Afghans in Germany are particularly heavily involved in gang rape.”

On Monday, the X account Wall Street Silver distributed the graphic that apparently got Kaiser into legal trouble.

It showed that for every 1 million inhabitants, 41 Afghans and 23 Africans were identified as rape suspects.

In comparison, the same was true for only three foreigners who did not belong to these groups and only 0.6 for native Germans.

The graphic also pointed out that Afghans and Africans were 40 times and 70 times more likely to commit rape, respectively, than native Germans.

In her first court case, Kaiser declared: “The mere mention of numbers, data and facts is punishable because the establishment rejects reality. I will not be silenced.”

When Judge Heiko Halbfas issued the ruling rejecting their claims this week, he said: “Anyone who attacks human dignity cannot invoke freedom of expression.”

The judge believed Kaiser “intentionally created an image in the minds of others that led to hatred of a nationally specific group,” the European Conservative reported.

Kaiser will reportedly appeal again.

“The whole world is astonished by this decision by the German courts,” she told the media. “My trust in the German constitutional state was severely shaken again yesterday, but all the letters (from supporters) give me courage and confidence.”
