Kerala court sentences Madhya Pradesh man to 33 years in prison for raping girl

A Kerala court on Friday sentenced a man from Madhya Pradesh to a total term of 33 years in prison for raping a 15-year-old girl from West Bengal in Poopara in the state’s hill district.

The judge of the Devikulam Fast Track Special Court (POCSO) in Johnson, MI, sentenced 27-year-old Khemsing Aiyam to separate jail terms totalling 33 years for violations of the Protection of Children from Sexual Offences Act (POCSO) and the IPC, said Special Public Prosecutor (SPP) Smiju K Das. However, the man will only have to serve a jail term of 20 years as the sentences have to be served concurrently and 20 years is the maximum jail term imposed by the judge, the SPP said.

Aiyam is the second accused in the case. The first accused, Mahesh Kumar Yadav, is on the run as he was released on bail.

The court also imposed a fine of Rs 150,000 on the convict, which will be paid to the victim, the prosecutor said.

The court also recommended that compensation be paid to the victim under the Victims Compensation Scheme and directed the Idukki-Thodupuzha District Legal Officer accordingly, the SPP said.

According to the prosecution, the girl came to Rajakumari, a village in Idukki, with her parents, who had come to the state for work purposes. Yadav, who was friends with the parents and the girl, took her to Aiyam’s house and raped her there, the SPP said, adding that the crime took place in 2022.

Aiyam then threatened the girl and took her to Poopara, where he raped her in a plantation there, the prosecutor said.

The girl is also the victim of a gang rape. In January this year, all three defendants were found guilty and sentenced to a total of 90 years in prison.

Since the sentences imposed on the three defendants must be served concurrently and the maximum prison sentence is 25 years, they will serve 25 years in prison.
