Gang rape of minors: two charges

They were charged under Section 375B of the Penal Code, which provides for a prison sentence of between 10 and 30 years and flogging if convicted.

Malaysia: Two men have been charged with raping an underage girl. Norazwan Shah Alawi, 29, and Muhammad Shazwan Ab Rasul, 21, each pleaded not guilty before District Court Judge Amir Shah Amir Hassan after the charges were read to them.

They were accused of raping the 16-year-old and 11-month-old girl between 10.30pm on Dec 19, 2023 and 1pm on Dec 20, 2023 in a rented room at Putatan Commercial Centre, Jalan Pintas Putatan. They were charged under Section 375B of the Penal Code, which carries a jail term of between 10 and 30 years and whipping. The court set July 29 as the pre-trial hearing date and released them on bail of RM8,000 and two local sureties. One of the sureties must be from the Kota Kinabalu area. The duo were also ordered to report to the police every month and retain their passports, if they have them, pending the disposal of their case by the court.

Earlier, Deputy Public Prosecutor Al Hakim had proposed bail of RM20,000 for each of the accused. In requesting a lower bail, the two told the court that they are from Semporna and have families to support.

In another case, a 37-year-old man charged with raping a minor girl will face trial on March 1 and 10 next year. Mohd Addy Moksan is accused of raping the 14-year-old girl at a house in Kg Tambun, Kota Marudu at 3pm on June 2023. In another case, a 21-year-old disabled person charged with raping his step-niece was admitted to Hospital Mesra in Bukit Padang for psychiatric monitoring. District Court Judge Amir Shah Amir Hassan made the order for the man, who has a learning disability. The court made the order after being informed by the prosecution that the man is disabled and based on the accused’s conduct in court. After the charge was read to him, he said nothing and the court did not record his confession. The court then suggested that the man be sent to hospital for psychiatric monitoring to determine whether he is fit to stand trial. The prosecution agreed to the suggestion. The court set July 30 as the date for the hospital result to be announced. The man, then 19, is accused of raping the 14-year-old girl at a house in Kudat at 3am on January 4, 2022. The offence under Section 376(2)(d) of the Penal Code carries a prison term of between 10 and 30 years and flogging upon conviction. Deputy Public Prosecutor Siti Hajar Mazlan appeared for the prosecution while the man was unrepresented.
