Rape of his stepdaughter: Man gets 15 years and 10 strokes

Sandakan: A 39-year-old Indonesian man has been sentenced to 15 years in prison and 10 strokes of the cane for raping his stepdaughter. Judge Zaini Fishir @ Fisal imposed the sentence on the man who pleaded guilty to raping the 14-year-old girl at noon on May 5 this year on a palm oil plantation.

The offence under Section 376(3) of the Penal Code carries a prison sentence of between 10 and 30 years and a minimum of 10 strokes of the cane upon conviction. After serving the prison sentence, the man was handed over to the Immigration Department for deportation. The court was informed that the victim had followed the man to collect the palm fruit in the said estate where the rape took place. The incident came to light when the victim told his grandfather (plaintiff) about it on 28 May this year.

The victim also told the grandfather that the man had threatened to kill her mother and siblings if she told anyone about the incident. She said the stepfather had raped her several times since she was 11 years old.

The plaintiff, along with the victim’s family, went to the defendant’s home and asked about the rape incident, which the defendant admitted to. The man was arrested after the victim reported the incident to the police. Assistant District Attorney Bryan Francis appeared for the prosecution while the man was unrepresented.
