The family of Jeffrey Spyrka, who was seriously injured in a construction accident in Chicago, is suing Turner Construction and Adjustable Forms Inc.

CHICAGO (WLS) — Four days after surviving an eight-story fall from a scaffold swaying in winds of up to 40 mph, the family of injured steelworker Jeffrey Spyrka is filing a lawsuit accusing two companies of “careless and negligent action”: general contractor Turner Construction and subcontractor Adjustable Forms Incorporated.

Attorney Lou Cairo says last Thursday’s incident at the University of Chicago’s Cancer Pavilion project caused the southwest corner of the scaffolding to break away from the building.

“They just wanted their job done because time is money and profit comes before safety,” Cairo said.

The lawsuit alleges that workers had complained about the stability of that corner days earlier, when the scaffolding was closer to the ground, and that the subcontractor told them the problem would be fixed.

“This scaffolding was not properly inspected. It was not properly constructed,” Cairo said. “The way it was supported in the corners, which is the most critical part of the scaffolding, was flawed.”

David O’Donnell, a 27-year-old engineer, fell to his death and his family is preparing to file a lawsuit later this week.

Spyrka, 36, a married father of three, somehow survived after landing on bundles of PVC pipes.

Doctors from the neighboring University of Chicago Medical Center rushed to his aid. Spyrka suffered numerous broken bones as well as severe internal injuries and head injuries, but his lawyer says he is responsive and not paralyzed after several operations.

“Heaven simply doesn’t have room for another angel right now, because the fact that he’s still alive is a miracle,” Cairo said.

Subcontractor Adjustable Forms Incorporated did not respond to our messages about the lawsuit. General contractor Turner Construction says it is aware of the lawsuit and is still investigating the incident.
