Biker sentenced after attacking woman’s car near City Hall – NBC10 Philadelphia

A motorcyclist accused of smashing the back of a woman’s car near Philadelphia City Hall while her young children were inside and then waving a gun in her direction has been sentenced to one to four years in prison, according to court records.

Cody Heron, 27, pleaded guilty in February to two counts of aggravated assault and possession of a weapon in the Oct. 1 attack. He was sentenced to one to four years in prison on one count and five years’ probation on two other counts, court records show.

Heron was among a group of ATV, motorcycle and dirt bike riders gathered near City Hall, surrounding a sedan driven by a 23-year-old woman. A video from another vehicle that went viral shows a helmeted motorcyclist exiting his motorcycle to jump into the back of the sedan, smashing the window with the two young children inside. What appears to be a gun falls from his waistband, and he appears to wave it toward the woman as she exits the car, and then he head-butts and shoves her when she confronts him.

Defense attorney Justin Capek told the Philadelphia Inquirer in a statement Wednesday evening that his client had “fully accepted responsibility” and apologized to the woman and her young children.

Capek called the sentence “fair and just” for his client, adding that it “does not preclude his opportunities for rehabilitation.” He said Heron “looks forward to reintegrating into society as a law-abiding citizen” and wants to “leave this abnormal scar on his legacy behind him.”

Court records indicate he is “suitable/recommended” for the Department of Corrections’ Motivational Boot Camp program, a six-month military program designed to reduce recidivism, and he would also receive credit for time already served.
