Man from Shelby allegedly raped two children

A 43-year-old Shelby man could face life in prison if convicted of raping a toddler.

David Irwin faces seven counts of rape, five counts of sexual assault, four counts of unlawful sexual intercourse with a minor and four counts of gross sexual assault.

The Richland County District Attorney’s Office released information about the charges on Wednesday.

“This is a sad case,” said Teri Burnside, first assistant district attorney.

Burnside said there are two alleged victims in the case. Irwin is accused of rape and four counts of sexual abuse of the younger of the two. The alleged abuse occurred between March and December 2023.

Since the child was under ten years old, he faces a life sentence for rape.

The other six counts of rape, as well as all counts of sexual assault and unlawful sexual conduct with minor allegations, relate to a girl who was 12 years old when the alleged abuse began. Irwin is accused of committing the offenses over a four-year period, from July 2019 to last July.

In 1998, Irwin was sentenced to prison for sexual assault.

His trial is scheduled for July 30. Irwin is being held in the county jail and bail is set at $1 million.

The grand jury also indicted Nicholas Tess, 35, of Butler, on charges of attempted murder, four counts of aggravated assault and resisting arrest.

His charges stem from an incident on April 12 at Rainbow Gardens, a bar in Lucas. Burnside said Tess stabbed two men with a knife.
