Jay Johnston: Actor, known for roles in “Bob’s Burgers” and “Arrested Development,” pleads guilty to role in Capitol attack

Jay Johnston, the actor known for his roles in “Arrested Development,” “Bob’s Burgers” and other television series, pleaded guilty on Monday to his involvement in the attack on the U.S. Capitol on January 6, 2021.

Johnston pleaded guilty to one count of disturbing the peace.

Prosecutors allege that Johnston was involved in the violent attacks on police officers that took place in the Capitol’s Lower West Terrace tunnel on Jan. 6. According to charging documents, Johnston took a riot shield from officers and used it to attack police officers defending the tunnel.

The charging documents also say that Johnston admitted to his involvement in the Capitol attack and sent a text message saying it was “not actually” an attack to an aide who was asked by FBI investigators to confirm photos showing Johnston at the Capitol on Jan. 6.

“The news portrayed it as an attack. It actually wasn’t,” Johnson said in the text message. “I thought it somehow got to that point. It was chaos. I was sprayed with pepper spray and tear gas and I found it pretty untouchable.”

Johnston’s sentence is scheduled to be announced on October 7 before U.S. District Judge Carl Nichols. He faces a maximum of five years in prison.
