Based on a complaint from the driver of the youth’s family, the Yerawada police have registered a separate offence against the teenager’s grandfather and father under sections 365 (abduction with intent to secretly and unlawfully confine a person) and 368 (wrongfully concealing or confining a person) of the IPC, he said.

“After the accident, the teenager’s grandfather and father allegedly took the driver’s phone and locked him in his house on the premises of their bungalow from May 19 to 20. The driver was rescued by his wife,” PTI quoted the crime branch official as saying.

A Porsche allegedly driven by the teenager, who police said was drunk at the time, killed two software developers riding motorcycles in the Kalyani Nagar area of the city in the early hours of Sunday morning.

On Friday, a Pune court remanded the six accused arrested in the case, including the teenager’s father, to judicial custody. The teenager has been remanded in an observation home until June 5.

“An attempt was made to prove that the teenager was not driving the Porsche,” says top police officer from Pune

Pune Police Commissioner Amitesh Kumar said attempts were being made to establish that the Porsche that hit and killed two people in the Kalyani Nagar area was not driven by a 17-year-old. The driver, employed by his family, even tried to claim responsibility. Two police officials have been suspended for negligence during the investigation.

Late Friday evening, the investigation was handed over to the Crime Branch from the Yerawada police station, where the original case was registered.

The Madhya Pradesh-based parents of the two IT professionals who died in the May 19 accident demanded that the Supreme Court oversee the investigation and that the trial be held in their state.

There is enough evidence to prove that the teenager was driving the car, Amitesh Kumar told reporters. “We have the video footage of him (the youth) drinking alcohol in the bar. He was of sound mind and knew full well that due to his behaviour such an accident could happen, to which Section 304 of the Penal Code is applicable,” said Kumar. Section 304 deals with intentional killing, which is not considered murder.

Was pizza served?

Regarding reports that the youth was served pizza after the incident, Amitesh Kumar said: “There was no pizza party at the police station.”

“But yes, something happened and we have launched an internal investigation,” he added.

“In the course of our investigation, it became clear that the teenager was driving the car and we have already collected all the necessary chronological evidence. For example, when the teenager left the house, the entry in the security register shows that he drove away in the car,” said the police chief.

What we know about the driver

Police said the driver of the teenager’s family was in the car. The police chief said they were trying to prove that he, and not the teenager, was behind the wheel when the vehicle struck two motorcyclists at about 3 a.m. Sunday, killing them.

After the accident, the driver initially claimed that he was driving the car, said the commissioner. “Why and under whose pressure he said that will be revealed in due course.”

The commissioner acknowledged that although the youth was admitted to Sassoon General Hospital at around 9am on Sunday, his blood samples were not taken until 11am, but insisted that “the blood report is not the basis of our case”.

As a precautionary measure, another sample was taken for a “DNA sample” at around 7 or 8 pm in the evening, he added. The reports have not been received yet, PTI reported.

In the original FIR, Section 304 A (death by negligence) was used, but it was revised with Section 304 on the same day as the crime warranted that (more serious) section, Kumar said. He said there were complaints that some eyewitnesses were put under pressure.

After the accident, the minor was produced before the juvenile court, which granted him bail and asked him to write a 300-word essay. Following an outcry over the quick bail and a request from the police to review the bail, the court on Wednesday remanded the teenager, the son of real estate developer Vishal Agarwal, in an observation home until June 5.

Police arrested the teenager for “exposing a child to endangerment” and the owner and employees of two bars where the teenager consumed alcohol for “serving alcohol to minors.”

On Friday, prosecutors requested an extension of police custody, but the court ordered all six defendants to remain in custody until June 7. They are expected to apply for bail next week.

Statements from the victims’ parents

The parents of Anish Awadhiya and Ashwini Koshta, both 24-year-old IT professionals who died in the June 19 accident, said they would not rest until justice was done. Suresh Kumar Koshta, Ashwini’s father, told reporters in Jabalpur that the Supreme Court should monitor the investigation and trial. “I will fight for justice until my last breath,” Anish’s father Om Prakash Awadhiya said over the phone.

He demanded that the trial should take place in Madhya Pradesh and not in Pune.
