Liability for dump truck accidents in New Jersey

According to Engineering News-Record, “the number of dump truck accidents severe enough to require towing increased 9%, reaching 8,206 in 2016, the most recent year for which statistics are available.” Dump trucks can be particularly dangerous for pedestrians and passengers of smaller vehicles. There are several reasons why dump trucks can be dangerous.

  • Dump trucks can weigh up to ten times more than passenger cars, so even low-speed collisions can have devastating consequences.
  • Dump trucks have large blind spots that can obscure smaller vehicles and pedestrians.
  • Dump trucks have a high center of gravity, which can cause pedestrians and smaller vehicles to be pulled under the hood.

Dump truck drivers must do everything in their power to avoid accidents. Many dump truck accidents have been caused by drivers making dangerous left turns. According to NJ Rev Stat § 39:4-123, drivers attempting to turn left must yield the right of way to oncoming vehicles that are close enough to pose a hazard. If a driver fails to yield the right of way to another driver before an accident, it can form the basis for a negligence claim. Several factors may contribute to any truck accident.

  • Speeding
  • Distraction while driving
  • Bad weather
  • Poor road conditions

Car accidents can be extremely traumatic for everyone involved. They can be especially hard on families when someone is killed in the process. To make matters worse, the company that operates the dump trucks will often do everything in their power to deny liability if one of their drivers is involved in an accident. This is one of the reasons why it is so important that evidence is properly preserved after an accident. The family of someone killed in a dump truck accident may be able to obtain some measure of justice through a civil lawsuit.
