Rape acquittal: Court acquits man in rape case due to unclear witness statements | Delhi News

New Delhi: A Delhi court has acquitted a man accused of rape, saying that the victim’s statement was neither clear, coherent, credible nor trustworthy. Moreover, her allegations were not substantiated by any other evidence. Additional Sessions Court Judge Priyanka Bhagat in her July 9 verdict observed that the entire prosecution case was based on the complainant’s statement. She mentioned that her version of the incident of spiking her food had major contradictions which affected the credibility of her statements. The court was hearing a case against a man named Mahender, who in 2014 allegedly spiking the victim’s food, raped her and filmed the incident after she fell unconscious in Nainital. After returning to Delhi, the accused allegedly threatened to circulate the video clip and raped her in an under-construction building. The case was filed against him at Subzi Mandi police station under the criminal sections of rape and criminal intimidation. “The prosecution fully alleges that the complainant was repeatedly raped to blackmail the accused Mahender into making the said video viral. However, the said video was never produced as evidence by the prosecution,” the court said. Referring to the alleged incident of wrongful confinement from November 11 to 15, 2014, the court, pointing out her contradictory statements, said she had admitted to having access to Mahender’s mobile phone at that time.
