Rhode Island releases illegal immigrant who raped person with “severe mental disability”

ERO Boston arrests Colombian national accused of sex crimes against Rhode Island resident (ICE)

The Boston unit of Enforcement and Removal Operations (ERO) recently arrested a Colombian national accused of a disturbing series of sexual and assault offenses against a Rhode Island resident with a severe intellectual disability.

These concerns not only underscore ERO’s critical role in protecting our communities, but are also a stark reminder that we urgently need to address the scourge of sexual violence perpetrated by non-citizens seeking to exploit the vulnerable.

On May 22, deportation officers from ERO Boston’s Providence Field Office arrested Rigberto Hoyos-Alban, a 33-year-old Colombian national, in Cranston, Rhode Island. Hoyos-Alban’s arrest came shortly after a series of charges were filed against him, including four counts of sexual assault and one count of assault on a person with severe intellectual disability.

Hoyos-Alban’s criminal history dates back to November 2023, when U.S. Border Patrol arrested him near the Rio Grande Valley in Texas after he illegally entered the United States without proper inspection, entry, or parole by a U.S. immigration officer.

Despite receiving a summons to appear before a Justice Department immigration judge, Hoyos-Alban was released on parole.

On March 13, Central Falls, Rhode Island police arrested Hoyos-Alban and charged him with two counts of first-degree sexual assault, two counts of second-degree sexual assault and aggravated battery on a mentally disabled person.

Deportation officers from ERO Boston’s Providence Field Office promptly filed an immigration arrest warrant against him with the Rhode Island Adult Correctional Institute on March 14.

However, The facility did not comply with the detention order and released Hoyos-Alban from custodya missed opportunity that could have prevented the subsequent arrest.

“Rigberto Hoyos-Alban has been charged with four counts of sexual abuse and one count of assault on a person with a severe intellectual disability,” said Todd M. Lyons, ERO New England field office director. “This is not the type of person we want on the streets of our New England neighborhoods. ERO Boston will continue to put the safety of our people first by arresting and removing violent non-citizens from our communities.”

Deportation officers from ERO Boston’s Providence Field Office arrested Hoyos-Alban in Cranston on May 22. Hoyos-Alban is currently in ERO custody awaiting the outcome of his deportation proceedings.
