Jail and caning for construction worker who sexually assaulted 16-year-old girl in Cheras PPR lift

KUALA LUMPUR, July 22 – A construction worker was sentenced to three years in prison and one stroke of the cane by the local District Court today after pleading guilty to sexually assaulting a girl in an elevator last week.

Judge Mohd Kafli Che Ali sentenced 40-year-old G. Mohana Das and ordered him to serve the sentence from the date of his arrest, July 15.

The court also ordered him to undergo psychological counseling for one year during his prison sentence and to be placed under police supervision for one year after serving his sentence.

He was accused of committing the crime against the 16-year-old victim in an elevator at a People’s Housing Project (PPR) in Cheras at 11.30am on July 15.

The charge under Section 14(a) of the Sexual Offences Against Children Act 201 carries a sentence of up to 20 years imprisonment and flogging if convicted.

According to the facts, on that day, the girl entered the elevator to return to her house on the 17th floor, and at the same time, the accused also entered the elevator. Then he touched the girl’s hand and when she pushed him away, he touched her breasts.

When she returned home, she told her mother about the incident, who reported it to the police that same day.

As part of the mitigation measures, Mohana Das, who was without legal representation, told the court that he was separated from his wife and was responsible for the maintenance of a child and his mother.
