Men accused of attacking San Jose police officer during sideshow face trial – NBC Bay Area

Two men accused of attacking a police officer in San Jose and kicking a patrol car appeared in court for the first time on Monday.

The crimes they are accused of occurred on June 15 at a sideshow in Santana Row and were captured on video.

Tyler Durbin, 22, and Gabe Durbin, 26, are suspected of assaulting a police officer and delaying him by threatening him with violence.

“Two individuals, along with others, attacked a police officer, making them incredibly dangerous to you, me and our families. Such individuals belong behind bars,” said Santa Clara County District Attorney Jeff Rosen.

The Durbins were arrested last Wednesday in San Juan Bautista.

Their lawyers requested that their clients be released on bail on the grounds that the two men were currently living on a reservation in Arizona and had no criminal record.

The judge decided to keep them in jail without bail but scheduled another hearing for Friday, partly because their lawyers said they needed more time to meet with the two men and review the charges.

The district attorney said they are still looking for the other people captured in the video.

“There is another individual who attempted to kick in the windshield of the officer’s police car, and that individual has not yet been arrested,” Rosen said. “If anyone in the public has information on the whereabouts of that individual, they should contact police.”
