Porsche accident in Pune: JJB sends teenager back to observation home till June 5 | Pune News

The Pune Juvenile Justice Board (JJB) on Wednesday sent back to an observation home the 17.5-year-old boy accused of drunkenly driving a Porsche at high speed and killing two software engineers on Sunday . He was detained at the Nehru Udyog Kendra Observation Home in Yerwada until June 5.

The panel is expected to decide on the police’s plea to try the minor as an adult at a later date after various proceedings under the Juvenile Justice Act are completed. Arguments on this plea did not take place on Wednesday, but the petition has been placed on record, officials said. Aneesh Awadhiya and Ashwani Koshtha, engineers working in Pune’s Kalyani Nagar area, were killed after the speeding Porsche driven by the 17.5-year-old son of a Pune-based realtor hit their motorcycle in the Yerwada area early on Sunday.

The JJB, which had earlier granted the low bail, had asked him to appear before it on Wednesday. The minor arrived at the JJB premises around midday on Wednesday accompanied by his family members and a legal team.

The defense lawyers and the public prosecutor presented their arguments following which the three-member JJB decided on Wednesday evening that the boy will be remanded to a juvenile correctional home in Yerwada until June 5. The JJB’s decision to try him as an adult is likely to be announced at a later date after completing all procedures, which include psychological assessment of the minor under the Juvenile Justice Act, an official said.

A senior police officer who oversaw the investigation said: “The entire sequence of events leading to the accident is now being reconstructed as part of the investigation.” This includes establishing his locations and actions as well as the details of the accident itself. Speaking to the media following the JJB verdict, his lawyer Prashant Patil said, “Today the trial took place before the three-member Juvenile Justice Board. Police had filed a review application against the bail granted to the child in conflict with the law (CCL). We have set out our arguments against this review application. The state argued that CCL’s safety outside was at risk and therefore he should be placed in a residential rehabilitation facility. We spoke out against it. The police emphasized that the investigation into the case is ongoing and that the CCL should be placed in a rehabilitation home. We argued that in order for CCL to be admitted to a rehab facility after being released on bail, changes should have been made to the police application which were not included. Honorable JJB has decided that CCL must be sent to a rehabilitation home by June 5th. The conditions of this detention include psychological counseling. We just heard the operative part of the order today. We will receive the complete order tomorrow. We will discuss with the customer tomorrow whether we will challenge this order.”

Responding to the police’s request to try the minor as an adult, Patil said, “There are laid down procedures in the Juvenile Justice Act. The police have to file a chargesheet within one month of the registration of the offence. Two months later, reports on the overall condition of the CCL, including his behavioural and psychological aspects, are to be submitted. Reports on his rehabilitation and detoxification efforts, if any, are submitted. These factors are taken into account. So, the decision on whether to treat him as an adult or not will take 60 to 90 days.” Patil claimed that the JJB order was “not a cancellation of the earlier bail but a modification of the previous order.”

After being arrested following the accident on Sunday, the minor was produced before the JJB in Pune on the afternoon of May 19. The police had requested his custody in the juvenile observation center and also requested that he be tried as an adult. The JJB – which on Sunday consisted of only one non-judicial member instead of the previous three members, including a judicial member – had rejected both applications and granted bail to the accused on various conditions, including writing an essay, studying road safety norms, etc granted bail and undergoing addiction counseling. The Pune Police had then challenged this JJB order in the Pune District Court, which remanded the matter back to the JJB for adjudication again as per the provisions of the Juvenile Justice Act.

On Tuesday, Maharashtra Deputy Chief Minister Devendra Fadnavis, who also holds the House portfolio, had expressed shock at the “extremely lenient” manner in which the 17-year-old was released on bail by the JJB despite allegedly mowing down two people in a speeding Porsche in Pune.
