Mumbai, May 22 (PTI) A special POCSO court here on Wednesday sentenced a 57-year-old man to 10 years rigorous imprisonment for raping his mentally challenged minor daughter five years ago.

The man was found guilty of rape under the Indian Penal Code and the Protection of Children from Sexual Offenses (POCSO) Act by special judge RK Kshirsagar.

According to the survivor’s mother, her 17-year-old mentally challenged girl was home alone with her father on the day of the incident in March 2019.

In her complaint, the woman claimed that her daughter’s clothes looked disheveled when she returned home after work.

The girl started crying after seeing her but said nothing and walked out when the mother went to investigate, the complaint says.

In April 2019, the mother once saw her husband kissing and touching her daughter inappropriately. She then lodged a complaint at the Trombay police station in the city.

During the trial, the court relied on medical evidence and statements from the survivor’s mother to find the father guilty.

Because of her cognitive disability, the 17-year-old remained silent when she was called to testify in court.

Her mother told the court that she had not been able to understand anything since she was born. The mother told the court that she had consulted many doctors for her daughter, but there was no improvement.

Prosecutors Rashmi Tendulkar and VD More examined six witnesses to prove the case.
