Boca Barwood is facing a lawsuit after an alleged electric scooter accident.

BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2024 MetroDesk Media, LLC) – A Boca Raton homeowners association is being sued by a man who claims the HOA’s poorly maintained parking lot caused him to crash his electric scooter caused.

Robert Clarfield claims that the Villas of Boca Barwood was responsible for his accident. From the complaint obtained by BocaNewsNow.com: “On or about December 9, 2023, (Clarfield) was lawfully driving his electric scooter in the parking lot surrounding 8904 SW 22nd Street, Boca Raton when he struck the uneven sidewalk and pothole. “ as a result of a dangerous condition on the roadway that resulted in significant permanent injuries. “

The lawsuit also accuses Boca Barwood of “negligently failing to maintain the parking lot pavement, or failing to maintain it adequately, so that it is uneven and has a large pothole, thereby creating a hazard to the public… negligently creating a hazard to the public from vehicles and Pedestrian created.” Use of said premises…Negligent failure to inspect or adequately inspect the parking lot surface to determine whether there were bumps and/or potholes…(and) Negligent failure to enforce the stated policy that certain employees of The Villas Of Boca Barwood is responsible for inspecting parking lot pavements for hazardous conditions.”

The complaint alleges that Mr. Clarfield suffered personal injury, including permanent injury to the entire body, pain and suffering of both physical and mental nature, disability, physical impairment, disfigurement, and more. It was not immediately clear why Mr. Clarfield was riding his scooter in a parking lot, what type of scooter it was, whether or not he was wearing a helmet and whether an ambulance was called to the scene.
